Mediation, which aims to resolve disputes with the assistance of a neutral and independent third party (the mediator), has become increasingly widespread in Türkiye.
Arta Law provides comprehensive legal services to its clients throughout all stages of both voluntary mediation and mandatory mediation required as a prerequisite to litigation.
Within this scope, Arta Law represents and advises its clients in the preparation and revision of mediation agreements, legal representation during mediation proceedings, drafting of settlement agreements reached through mediation, applications for the enforceability of mediation settlement agreements, and the enforcement of such agreements.
Where mediation is initiated before a lawsuit is filed, the mediation process begins on the date when the parties are invited to the first mediation meeting and subsequently agree, together with the mediator, to proceed with the mediation process, with such agreement being documented in an official record.
If mediation is initiated after legal proceedings have commenced, the process begins on the date when the parties accept the court’s invitation to mediation, or when they jointly notify the court in writing that they have agreed to pursue mediation outside the hearing, or when such declaration is recorded in the hearing minutes.
Our office prepares and provides all documentation required throughout the mediation process, including invitation letters, information records, opening minutes, subsequent session minutes, settlement agreements, final reports, and all other necessary legal documents.
